Notice of Special Meeting of RTM Legislative and Rules Committee
Please be advised that the Legislative and Rules Committee of the RTM will hold a special meeting of the Committee on Wednesday, May 17, 2023, at 7:30 PM ET in the Town Hall Meeting Room.
The Committee will be meeting with the Town Attorney and the Assistant Town Attorney to address the question whether the amendment of Item 3 of the April 2023 Call proposed by a member of the Town Services Committee (the “Amendment”) is in legal order. The Assistant Town Attorney opined that the Amendment was not in legal order, and a member of District 6 appealed the opinion on the basis that the Amendment was not in legal order but the reasons given by the Assistant Town Attorney were incorrect. That appeal has been referred to the Legislative and Rules Committee to meet with the Town Attorney and to report back to the RTM at its June 2023 meeting. The Committee may or may not vote on the issues that arise in the review of the opinion and the appeal.

Clarification of Notice of Special Meeting of RTM Legislative and Rules Committee
On May 15, I posted a notice of a special meeting of the Legislative and Rules Committee to be held on May 17, 2023 at 7:30 in the Town Hall Meeting Room.
I made a misstatement in that notice. I wrote that the amendment of Item 3 of the April 2023 Call proposed by a member of the Town Services Committee (the “Moss Amendment”) had been ruled not to be in legal order by the Assistant Town Attorney. That was incorrect. The Assistant Town Attorney’s opinion applied to the amendment that had been proposed by the Town Services Committee. The member of District 6 who appealed the ruling on legal order agreed that the Town Services Committee’s amendment was not in legal order, but the reasons given by the Assistant Town Attorney were legally unsound. The appellant has found that the Moss Amendment is in legal order.
The Committee will be meeting with the Town Attorney and the Assistant Town Attorney to address how the Town Services Committee’s amendment differs from the Moss Amendment.
The appeal has been referred to the Legislative and Rules Committee to meet with the Town Attorney and to report back to the RTM at its June 2023 meeting. The Committee will vote on the issues that arise in the review of the opinion and the appeal.
